Jailed Popular Zambian Musician Clifford Dimba, alias General Kanene has appealed to the Supreme Court against his conviction and later sentencing to 18 years with hard labour.

General Kanene is contending High Court Judge Charlwe Muchenga sentencing him to 18 years in prison with hard labour following the Magistrate Court’s conviction him for defilement.

He argues the trial Magistrate did not determine the correct age of the girl to prove the allegation of defilement against him as there was no birth certificate to prove her age.

The named girl of Kamwala Township is said to be in Grade 7.

When convicting the Muscian, Magistrate Rogers Kaoma said although General Kanene in his defence had claimed that the girl dressed like a sex worker to entice men, the claims was unfounded because a closer analysis of the girl by the Court proved to the contrary.

Magistrate Kaoma said General Kanene as a Musician should behave as a role model and not to take advantage of his young fans by having unlawful carnal knowledge of them.

The Magistrate said it was clear from a mere look at the girl that she was under the age of 16, although she had no birth certificate.

The case will now be determined by the Supreme Court.
