Con Court declines to discontinue Lungu’s eligibility case

The Constitutional court has declined to discontinue a matter in which UPND Katuba Member of Parliament Bampi Kapalasa and a Lusaka Citizen, Joseph Busenga petitioned the court seeking interpretation on President Edgar Lungu’s eligibility to contest the 2021 general election.

This follows a plea by the applicants’ lawyer, Mulambo Haimbe who wanted the court to have the matter discontinued.

In his application, Mr. Haimbe informed the court that he had received instructions from both applicants to withdraw the matter based on reasons he could not disclose.

But the Attorney General Likando Kalaluka objected to the submission, saying hearing the matter will bring to an end the debate surrounding the eligibility of President Lungu.

Equally, Solicitor General Abraham’s Mwansa said the court should not be deemed as playground where litigants can choose to withdraw matter at any time they feel like.

In making the ruling on behalf of a full bench constitutional court judges, Justice Mungeni Mulenga said the court will hear the matter having heard the submissions by both the applicants and the respondent. -Diamond TV
