UPND injunction application to be determined today by High Court

FB_IMG_1472852906673The Lusaka High Court is today at 16:00 hours expected to rule on an application in which the United Party for National Development (UPND) is seeking an order to restrain Chief Justice Ireen Mambilima from swearing in Edgar Lungu and his running mate Inonge Wina as Republican President and Vice President respectively.

High Court Judge Mwila Chitabo will also deliver a ruling on the application by the Attorney General Likando Kalaluka to declare the UPND as vexatious litigants.

The state has contended that the UPND has presented a multiplicity of applications before the courts of law and should not be allowed to commence legal proceedings without permission from the courts or a judge.

After sitting from 14:00 hours up to 23:00 hours, the High court concluded by adjourning the matter to Friday September 9 at 16:00 hours for ruling.

In a related matter, the  Costitutional Court made the injunction application filed by the United Party for National Development an academic exercise after adjourning the matter to 21st September 2016.

    • As things stand now, there is no injunction given against the inauguration.

      Thus, the inauguration is not challenged but merely questioned by the UPND.

      There is no restraint to the proceedings of the inaugural process.

      By virtue of not granting an injunction, it means that UPND is now only seeking to gain an understanding of whether it is right for Lungu to be sworn in or not. That information can come any time – before or after swearing in, does not matter.

      After all, the ruling of the ConCourt on monday has not been set aside, it is still valid.

      By that ruling, since the petition expired before hearing, it is as good as there having been no petition at all.

      Therefore the constitution court has no jurisdiction to declare a winner nor validate nor nullify the election.

      Thus, the pronouncement of the ECZ currently remains the only available and valid declaration, as it can only be changed by ConCourt following a successful petition process.

      So what zambian eye have stated is a correct legal position.

    • Look there are two matters filed by the UPND in court regarding the petition/inauguration issue.

      1) UPND has sought the interpretation as to whether their rights have not been violated by the decision of the ConCourt over their petition, and have the court determine if the petition can still be heard.

      2) The UPND have now taken to the ConCourt the application which was seeking an injunction in the High Court meant to stop the inauguration, but which was thrown out by the High Court. Now they want the court to determine whether the inauguration can go on. The court has set 21 September as interpret heating, but no injunction, nor setting aside of the Monday ConCourt ruling has been given.

      Thus, this may as well be for purpose of information to the UPND – to find out if the said inauguration can take place. Thus, after finding out on 21 September they may decide the next course of action, whether this will be before or after the inauguration, we are yet to see, but at the moment there is neither an injunction nor a petition to hinder the inauguration.

Because the genuine Zambian people put ECL to the throne of presidency on 11th August,2016 who is yet to be sworn in on 13.09.16 by the Chief justice.   7. BEFORE GOING TO THE CC THE UPND TOLD US THAT THEY HAD OVERWELMING EVIDENCE OF RIGGING. BUT WHEN THEY WENT TO THE CC THEY FAILED TO PRODUCE THE EVIDENCE IN 14 DAYS. THEIR LAWYERS REALISED THAT WHAT THEY WANTED TO PRODUCE AS EVIDENCE WAS ACTUALLY RUBISH AND FRIVOROUS.SO THEY RESORTED TO RELY ON HEAPS AND HEAPS OF MOUNTAINS OF PRELIMINARIES WHICH HAD NO BEARING ON THE MAIN CASE. THEY ENDED UP RUNING OUT OF THE CONSTITUTIONALY PERMITTRD TIME, THUS THE WHOLE PETITION WAS THROWN OUT. IT WAS BUNGLED UP.

  15. Can somebody explain the Role of the AG in this case? Whose interests does the AG represent? The AG made an Application to the HC against the Petetioners in what capacity? The AG seems to be acting as an extension of both Lungu’s Defence Team and the Concourt bench. The AG is masquerading as one of the Concourt judges. Rather than assist the Courts the AG has contributed to current confusion in Concourt. The AG and SC’s roles need to be defined. These two govt officers do not seem to be acting and protecting the best interests of the public at all.
