UPND applies to amend petition

FB_IMG_1472219468091The Constitutional Court today threw out the application by the Registrar of the Constitutional Court that there is no space to keep the election materials.

The court ruled that the Registra being a judicial officer has no legal standing, because the registrar ‘s affidavit seemed to support the interests of the Respondent (Edgar Lungu and others).

UPND lawyers argued that the Registrar is a judicial officer and therefore his affidavit be expanded.

In delivering the ruling , the Constitutional Court Judge ruled in favour of UPND.

Meanwhile the court has allowed an application from the UPND to amend the petition which will come up before the court on Monday 29th August 2016 at 9hrs .

On Tuesday ,the Respondents’ lawyers (Edgar Lungu and others’ lawyers) must file an answer.

There was drama in court when PF lawyers in their usual style of confusion almost claimed not to have been served with the application by the petitioners (UPND ) to amend the petition and they ended up giving contradictory statements.

Some PF lawyers said they have not been served while others said they have been served.

  1. The original thought for UPND has suffered setback.

    This means the shape and spirit of the petition has been deformed.

    That means UPND lawyers will be less organized than earlier on. If earlier on they were not organized it’s gonna get worse now.

    • In any case what is the use ?
      Because what I would like to believe is that even if HH’s petition succeeded and there was 2nd run, both HH and GBM may not be eligible to stand because they may be answering criminal charges at the haggie.

      • And Edgar will be disqualified for having undermined the constitutional court by not handing over executive powers to the Speaker during the petition, as for Bo Inonge I can even stand against bo Inonge and win an election anywhere anytime even without campaigning…….

        • You have not read the constitution, if you have read, you do not understand it.

          It is actually wishful thinking to hold that view.

          Those are the views that simply excite you memontarily,just like in your dreams, and end when you are back to your senses.

          There no handing over power when a petition fallows first round election declaration, which is dealt with under article 101 of the constitution.

          Handover of power comes only when a petition is made following a second run, which is covered under the article 103 of the constitution.

          I know, it is good to have wishful thinking; it excites quite a bit.

          But there no article that allows any politician to order his supporters to rise up following an election defeat. HH did that, and it is on record. He told his supporters to rise and not be docile.

  12. This has nothing to do with HH as a person. It is about the future of our electoral processes and our young Constitutional Democracy.We stood in queues for hours to cast our votes to elect a govt of our choice. We feel our votes were stolen and therefore didn’t count despite the effort. The Petition gives us a chance to assess whether or not there was a manipulation of votes.We cannot condone vote thieving and we want culprits to be punished. If this is not done most of us will not bother to vote in future if we are convinced our votes cannot change anything. Concourt has a huge responsibility to act impartially and restore some trust and confidence in our electoral processes.There is a perception that ECZ has not conducted the 2016 elections properly and professionally. This will give the govt a chance to restructure ECZ and make it more effective for future elections and of course vote thieves and riggers will be punished.All eyes on Concourt.

If you won in Choma does not mean you won in kitwe or Mansa. Moreover, you had observers who not only checked for HH but an Mp candidate for UPND. It does not make sense for your MP candidate not to have complained for receiving less votes But, you expect HH to win miraculously. I can not go in details because it seems you never did logic at school. Even this case at the Con Court is just a technical exercise, people already voted. ECL won in fact with more MPs than HH. The worst will be a rerun. Think.

Sometimes I find it difficult to understand certain people, HH has never said anything close to rejecting elections that don’t go his way, what he has however said is that he will not accept a stolen election, a fraudulent election, a rigged election, this is what he has said and rightly so. If you as pf have no problems with a stolen election, good for you, UPND is not pf so don’t expect that because you are content with so little then UPND should the same, wanama, UPND is not a party of jokers but a party of very serious, committed and patrotic Zambians whose allegiance is to the country Zambia and not a party or individuals. From the little knowledge I have failure to report a crime is a crime in itself so UPND is practicing good citizenship by seeking legal redress in the matter currently before concourt.
    One other funny issue is the stupid and foolish stone age argument by some so called pastor from the copperbelt who actually is my tribesmate who gave silly reasons for the so called UPND defeat. He says tribalism and bitterness are the cause of UPND defeat, what a pastor this one is. What about the other ones you believe are not tribal and bitter why haven’t they managed to make it to state house if your childish and devilish thinking is to make sense. You call yourself a pastor yet from your comment you are preaching hatred what a pastor you are.
    For all those asking strange people to go back to school, well what should instead be asked of them is for God’s intervention so that they for once can think about the bigger picture which is the country and not an individual or political party they support. I know that they have sufficient education to be able to understand what is and is not good for the nation except they have MISAPPLIED their allegiance to an individual and political party, that is where the problem is, its even worse now because some people have escalated this madness to tribal talk and politics.Look at the pf massage when in their strong holds, its don’t vote for this tribe, vote the way such a tribe votes, surely in this time and age people coming up with tribal groupings as in kumawa for chiteni iyo mwandi, these same people when in UPND strong holds, they change the language, don’t just vote for your own vote for us also. they deliberately mistake strong holds for tribal voting. There is nowhere in the world where you find a party capable of remaining in office or one capable of dislodging a ruling party from office can not have a strong hold. Strong holds can either be where the political leader comes from or where the party massage has been well received, simple.
    So for UPND to have decided to go to court for me that is tge most mature, civilized and democratic way of doing things. Unless somebody would have preferred that UPND picks up arms. Let everyone allow the concourt do the job for which it was set up, the people that came up with the idea of a concourt knew very well that African politicians if not kept in check will do anything from an illegality to murder just so that they consolidate their hold on to power. Rather than demonize UPND, one would have expected pf and its sympathisers to applaud UPND for move so that, should the court decide in pfs favour, pf will be vindicated but most Importantly learn something out of this mess.
    Lastly I ask everyone condemning the UPND action to to be cool about everything if their hands are clean.

    If the winning was by crook’s it must be challenged, why not? Pipo who say accept the results fail to comment why they should be accepted even if fake!

    Genuine results must be accepted not these where you announce a Chilubi Constituency which doesn’t exist!
