Things fall apart for Mutati as Court recognises Zaloumis as MMD National Secretary

Movement for Multi-Party democracy (MMD) faction leader Felix Mutati, who doubles as Minister of Works and Supply in the PF government today suffered a serious blow after the High Court recognized Nevers Mumba’s National Secretary Winnie Zaloumis as the party’s National Secretary.

This is in a case where Zaloumis has dragged Mutati, his national secretary Raphael Nakachinda and two others to Court on grounds that they had no authority to organise the illegal MMD Convention in 2016.

When the matter came up for hearing on October 30, 2018, Mutati had new lawyers in the name of Makebi Zulu and Associates after Lusaka prominent lawyer Eric Silwamba of Silwamba, Jalasi and Linyama abandoned him.

Mutati’s new lawyers immediately raised a preliminary application that Zaloumis had no right to take Mutati and the three to court because her mandate as party National Secretary ended in 2016. Judge Newa then reserved ruling in the matter to November 1, 2018.

In her ruling today, Judge Newa recognized Zaloumis as the MMD National Secretary. She further dismissed Mutati’s application, calling it a misapplication and an abuse of court process and awarded costs to Zaloumis.

Judge Newa then ordered that the trial of the MMD illegal convention case proceeds next week Tuesday, November 6 and Wednesday, November 7 2018.
