Suspended DPP Mutembo Nchito refuse to be tried in private

Mutembo's letterMutembo's letter 2Mutembo's letter 3Mutembo's letter 4Suspended Director of Public Prosecution (DPP) Mutembo Nchito has refused to be tried in camera or in private by the Tribunal set up by President Lungu.

When the matter is heard on camera it means Journalists and members of the public are not allowed in. It means the person being probed in this case Mr. Nchito, members of the Tribunal (Judges) and witnesses are allowed.

In a letter to Head of the Tribunal Judge Silungwe, Mr Nchito says he wants to be tried in an open court.

  1. EVEN IF MUTEMBO NCHITO IS WRONG IN ONE WAY OR THE OTHER THE HIS ISSUE IS BEING HANDLED IS UNACCEPTABLE, EVERY WELL MEANING ZAMBIAN CAN SEE THAT. THAT’S WHY THERE ARE LAWS, BUT WE HAVE SEEN THAT THINGS ARE DONE WITHOUT FOLLOWING PROCEDURE & IF IN THIS TRIBUNAL THERE WAS NO MONEY INVOLVED A PRINCIPLED PERSON CAN REFUSE TO BE PART OF IT, BECAUSE IT SERVE THE INTEREST OF INDIVIDUAL AND NOT THE PUBLIC. LET THEM DO IT OPENLY NOT IN SECRET.

Much as I never liked the appointment of Mutembo Nchito by the Chimbwi no plan – Sata, and finally ratified by parliament which was supported by PF including sick Edgar chagwa lungu, I see no reason of firing this man in the way Edgar wants to do it. Edgar may hate Mutembo and Fred M’membe but he should have respect for the costitutional office to which his created enermy Mutembo occupies. I therefore praise Mutembo for refusing to be tried under cangaroo courts but in open so that we know even the cases that they want to down play especially those involving some MMD officials that stole and abused authority when Zambians gave them time to take care of their affairs.
