Supreme Court to deliver ruling in Mutembo Nchito tribunal case today

The Supreme Court is today expected to deliver a judgment in a matter where the state appealed against Lusaka High Court judge Mubanga Kondolo’s decision to allow Mutembo Nchito to commence judicial review proceedings against the tribunal’s insistence to probe him in camera, among other issues.

According to a notice of hearing, the Supreme Court judges will deliver their verdict at 09:00 hours.

The state appealed against judge Kondolo’s decision to grant Mutembo, the suspended Director of Public Prosecutions, leave to challenge the holding in camera of the tribunal that President Edgar Lungu constituted to probe his alleged professional misconduct.

In the judicial review, Mutembo demanded that two tribunal members – justice Matthew Ngulube and Ernest Sakala – recuse themselves from sitting on the tribunal chaired by justice Annel Silungwe for alleged bias.

But the state appealed against the High Court’s decision.
