Sata, Masebo have no authority to cancel tender – ZPPA Director

President Micheal Sata has no authority to direct the cancellation of a public tender, a Director at the Zambia Public Procurement Authority (ZPPA) told the Tribunal probing Tourism Minister Sylvia Masebo.
And the Tribunal which is headed by Judge Roydah Kaoma concluded its sitting on Monday, March 10, 2014.
Gloria Ngoma, ZPPA director of Inspections and Standards giving her testimony Monday morning also said that the ZPPA Act does not allow the Tourism Minister Sylvia to cancel an ongoing tender process.
She told the tribunal that the ZPPA Act is explicit adding that only the approvals authority, procurement committee and the controlling officer can terminate or suspend a running tender.
Ms Ngoma explained that new members cannot be included to a tender evaluation process once it has commenced for fear of manipulation of the process.
But during cross examination by Masebo’s lawyer, Micheal Mundashi, Ms. Ngoma said there was an inconsistency detected during the evaluation process for 19 hunting blocks because the committee departed from the criteria.
She said it would have been appropriate to cancel the tender due to the inconsistencies.
And the Tribunal has winded up its sitting and all parties are expected to make their submissions by March 11, 2014.
Judge Kaoma said the findings of the tribunal will be ready by the end of March 2014. She said the findings will then be presented to President Sata and the Speaker of the National Assembly at the date to be communicated.
