Mwaliteta’s case to be heard in Kafue

The Lusaka High Court has dismissed an application by the Director of Public Prosecution for an order to have the case in which UPND Lusaka Province Chairman Obvious Mwaliteta is facing charges of being in possession of offensive weapons to be heard in Lusaka.

High Court Judge Sharon Newa says the DPP has not filed an affidavit in support of the notice of motion to enable her determine if there is sufficient basis upon which she can exercise her discretion to order change of venue from Kafue Subordinate Court to Lusaka.

In this case, the State wanted Mwaliteta’s case to be heard in Lusaka and not Kafue where the offense was committed citing security reasons in relation to alleged riots.
