MMD MPs petition Constitutional Court over holding of party convention

LUNTE MMD member of parliament Felix Mutati and two others have petitioned the Constitutional Court, seeking a declaration that a convention be held on or before April 11.

Mutati, Elijah Muchima and Annie Chungu, who are also members of parliament for Lunte, Ikeleng’i and Lufwanyama respectively, have cited MMD national secretary Mwansa Mbulakulima in this matter where they are seeking the court’s declaration that the resolution by the national executive committee (NEC) meeting that a convention should not be held is null and void.

The petitioners are also seeking an expedited determination of their Constitutional rights as the convention for the party  needed to be summoned a month before April 11.

The trio further sought the court’s declaration that Mbulakulima should not infringe on the rights of members of the party who are advocating for the holding of the convention in accordance with the Constitution of Zambia and the constitution of the party, among other reliefs.

According to the petition filed on Friday, the petitioners submitted that the last convention was held on April 11, 2011 and as such, in accordance with the provisions of Article 14 (1) of the party constitution,  the regular convention was due to be called on or before April 11.
