Lawyers in the treason case involving UPND president Hakainde Hichilema has complained of the conduct of the police at the Magistrate court in Lusaka.

Defence lawyer Jack Mwiimbu complained that despite the court directive on the conduct of the police there has been no change.

Below is the verbatim:

Jack Mwiimbu takes stand raises an issue on the conduct of police in court premise. We do recall that at our last sitting u provided guidance and rulings pertaining to conduct of police with regards to the right of counsel to enter court.

Counsel Mwiimbu continues , this morning a number of my colleagues were inconvenienced by the police who have locked up the main gate thus affecting our duties and other litigants.

This premise is under the court and if any need for extreme measures,consultations have to be made with the judiciary. We ask that you restate your position on the issue.

State advocate sakala agrees with the defence saying they equally have been inconvenienced but was quick to say it can only be sorted out by the police

Magistrate Malumani asks who the senior police is to which the public prosecutor Like said he could not tell.

Magistrate Malumani has tasked state advocates mwelwa and sakala to find out who is commanding the police batalion at court to which the two agreed in the affirmative.

  1. The police force in Zambia is a civill police and not militia. The police live with the people and depend for their success in their maintenance of law and order on cooperation with the public. Whether Constable Phiri, Constable Chanda, Superintendent Mwape, Commissioner Banda, Asst. Superintendent Chola, disguise themselves with black gogles, comouflage gear, sniper rifles, bombs, stalin organs, tear gas canisters, etc, we know them. They are our neigbours! They are acting as ‘useful idiots’ by being used to brutalise us.
