High Court orders re-instatement of Judges Kajimanga and Mutuna

The Kabwe High Court has ruled that suspended Lusaka High Court Judges Charles Kajimanga and Nigel Mutuna should be re-instated.

Kabwe High Court Judge, Mwiinde Siavwapa has ruled that Judges Kajimanga and Mutuna should resume their duties because the tribunal constituted to probe them is unable to carry out its mandate.

Delivering a ruling today, Justice Siavwapa says the fate of the two judges cannot continue to hang in the balance.

This is in a matter where Judges Kajimanga and Mutuna have challenged their suspension, and contend that the tribunal constituted to probe them was illegal.

The two judge were suspended by late President Michael Sata in 2012, along with retired Supreme Court Judge Philip Musonda, on account of allegations of professional misconduct.

The allegation of professional misconduct bordered on how they handled the matter involving POST Newspaper,JCN Holdings and Development Bank of ZAMBIA.

Immediately after suspending Judges Kajimanga and Mutuna, Late President Michael Sata appointed a tribunal to probe them.

The tribunal was chaired by Malawian Supreme Court Judge Lovemore Chikopa.
