High Court refuses to release HH

A Lusaka High Court Judge has thrown out an application filed by UPND president Hakainde Hichilema that he be released in the treason case.

Hichilema through his lawyers was seeking the High Court to set him free stating that there were no grounds in the treason case warranting his arrest and incarceration.

But the Judge has dismissed the application.

In her ruling Judge Betty Mong’omba said it was an abuse of court processes for Hichilema and 5 others to run to the High Court when they have filed in the Constitutional Court on the same matter.

She said there was no need for the opposition leader together with his 5 treason co-accused to petition both courts on the same matter.

  2. Very shocked and confused with this judgement. In the ConCourt HH is bringing up the issue of bail while in the high court it is the substance of the treason case. They are not mutually exclusive. Requesting bail in one court and asking to quash the treason case in another is not the same..

  3. Bail requires interpretation of the constitution. But trial is done high court.

  6. Where have you seen a judgement that refers to another court case not even a ruling but an application, I put it to you … HH will not get a fair hearing in the Zambia, Lungu, by commenting about the case, has poisoned the case and judges are intimidated judges in advance.
