Furniture company sues Lusambo for failing to pay K100,000

Lusaka Province Minister Bowman Lusambo was last week trending in news after he donated more than K1 million worth of goods and food stuffs to the residents of Ndola’s Kabushi constituency were he is area Member of Parliament.

But now Lusambo has been dragged to court for failure to pay for his furniture, the balance of which is less than ten percent of what he donated recently.

Lusaka furniture company, A AND J Interiors Limited has sued Lusambo for failing to pay K102,978.70 as balance for furnishing goods that they supplied him with.

According to a statement of claim filed in the principal registry by A and J Interiors Limited’s lawyers Chibesakunda and Company, the firm is claiming payment of K102,978.70, being the amount Lusambo is owing for the purchase of two Carlyle (arm chair), two Alberta sofas a Belushi mist rug, a Costello blade rug, a Manhattan dinning table and six Oxford dinning chairs.

The plaintiff stated that they entered into a contract with Lusambo in which he purchased furnishing goods at K198,700.

The plaintiff stated that according to the contract, Lusambo was supposed to make three equal payments of K66,233.33 in the months of April, May and June 2017 but that he failed to make consistent monthly payments.

The company added that Lusambo only made minimal payments of K95,751.30 which were erratic.

The plaintiff further stated that numerous reminders were made to the minister for payment of the money but to no avail.

“The failure to settle the outstanding amounts has had a negative effect on the cash flows of the company,” the plaintiff said. “To date, despite demands, the defendant has failed to settle the outstanding amounts owing to the plaintiff.”

The plaintiff is therefore, claiming payment of the money, damages for loss of revenue with interest on the damages payable.

They are further claiming any other relief the court might deem fit, costs and incidental to the action.
