Failure to serve summons delays presidential petition case

IMG_5649The case in which United Party for National Development (UPND) has petitioned the Constitutional Court challenging the declaration of Edgar Lungu as the winner of the 2016 general elections failed take off on Monday August 22.

The petition is scheduled to be heard within 14 days as prescribed by the new constitution but the case could not take off as the summons were not served to the respondents who include Lungu and Vice President-elect Inonge Wina.

The UPND legal team who briefed the media outside the court said they will serve all necessary summons on Monday in preparation for the commencement of the sitting on Tuesday.

It is alleged that the UPND lawyers had served the summons to the Attorney General, who is not a part to these proceedings.

But according to a source, the Lawyers had delivered summons to State House but the security detail wouldn’t allow them access forcing them to drop the court-papers outside.

The UPND successfully filed in a petition signed by its leader Hakainde Hichilema and his deputy Geoffrey  Bwalya Mwamba that the court may overturn and subsequent nullify Lungus elections as Republican President.

    • UPND can add more lawyers. That way, cash outflow can increase and be shared with more Zambians.
      HH and GBM have a lot of money and this is an opportunity for them to share.
      To qualify to share this money, you need to have ZIALE certificate.
      Otherwise, u trust the capability of the judges and justices; HH does not have valid grounds.

    • Stop trying to cause a civil war. Wake up man! Accept defeat and try again in 2020! Next thing there will be a civil war and the country will be divided like Sudan into North and South. You will set the country on fire. Try in 2020 with a younger man/woman who is not racist and only loves Tongas.       HH is entitled not to trust Lungu.
      HH is entitled not to trust ECZ.
      But you want Lungu to trust HH?
      ECL is legally entitled to remain in charge even before the verdict, after that he will be entitled to continue until 2021.
      ECL would have handed over power to the speaker if this petition was coming following a second run.
      Don’t think that whatever Mushipe says is gospel truth!!
      Law was never authered by Mushipe and the UPND. This is why HH and UPND should not put on a celebrating shoes.
      Let them just take off the dancing shoes, and wait for the verdict.

    I dont wish anybody bad BUT Lungu is creating alot of PROBLEMS for himself. You cant cheat GOD. As am writing he has closed Muvi TV. This is NOT Uganda Zambia has NEVER had Idiamini…… Our foundation is NOT as that of Somalia. Mark words if Lungu takes this route it WON’T be easy to govern.       Do you know when HH rejected these results?
      Before campaign even started. Is that OK for you.
      What HH is rejecting is not the election process, it is losing. Is that democracy for you?
      HH said if I win I will accept the results. He said if I lose I will not accept.
      Is that how you play politics?
      And you say HH is not funning trouble?
      Wishing people ill may just work against yourself.

  9. Lungu is just buying time and hoping he can use his influence to sway Concourt to dismiss the Petetion and confirm him duly elected President Elect. The problem is how Lungu and ECZ can prove that he did not rig the elections in his favour. It means Lungu and ECZ will have to uncook the election results that they cooked and declared Lungu the Winner.Its not easy to prove this but that is the challenge for Lungu and ECZ.

  14. Let’s not tell lies on this very important platform. HH has NEVER at any such a time said he will not accept defeat, what he has however said and rightly so is that, he will not accept a stolen election. I find it strange that someone can accuse HH of fanning trouble for exercising his democratic right to challenge what he sees as a stolen Victory. Courts are meant for such purposes otherwise scrap them off if you don’t want people to seek help when in need of the court’s intervention. That way you can have it your way.
    If lungu is able to prove that he got the required number of votes in this election without using or misusing the judiciary, well so be it. That way alot of people will give him a benefit of doubt, except for me ofcourse, I will still call it a fraudulent election for obvious and many such reasons. Today I have found another reason to justify my argument, refusal to receive court summons.
    Lastly I wish to remind the UPND legal team that, as and when the time for counting ballots comes, they should pay particular attention to the serial numbers and most importantly the voter’s card numbers. I say so because ecz officials were recording voter’s card numbers. So every cast ballot’s serial number should agree with the serial number in the ballot book which shoul have every voter’s card number.
