I would like to share with you the court documents showing Edgar Lungu was found guilty of stealing money belonging to his client, Mrs Wendy Kanyanta, after pretending to represent her.
This appalling act of dishonesty and criminal behaviour is the clearest representation yet of the character of the man attempting to become our president. It is shameful that Guy Scott deems him fit to lead our great country.

We cannot have a thief as our president. He has stolen from clients. We cannot now give him the opportunity to steal from our country.
I urge you strongly to please expose this.

RULING OF THE LAW ASSOCIATION OF ZAMBIA AGAINST MR. EDGAR CHAGWA LUNGU

On 16th April 2009, the Legal Practitioners Committee (LPC) of the Law Association of Zambia (LAZ) received a complaint from a Ms Wendy Kanyanta against Mr Edgar Chagwa Lungu claiming he had illegally obtained fees of K36,080.42 from compensation meant for her despite already being paid costs of K40,000.00 from the unsuccessful party, Lafarge Cement, who were her former employers.

Both parties were summoned before the LPC on 24th July 2009 and Mr Lungu was asked to respond to the accusation. Mr Lungu admitted having obtained the money on the understanding that they were legal costs due to him for the services rendered and that an agreement existed between him and the client – which was denied by the client. Following his response, the Legal Practitioners Committee asked for proof for this position but Mr Lungu failed to provide any.

At the next sitting of the LPC on 18th September 2009, it was proven that Mr Lungu did deduct his client’s monies illegally despite receiving costs of K40,000.00  from Lafarge. Mr Lungu did not dispute this finding of the committee and accepted he had acted illegally.

The LPC declared Mr Lungu’s conduct entirely illegal after referring to Rule 17(1) of the Legal Practitioners Practice Rules, 2002 which provides that, “a Practitioner shall inform clients about charges or fees and the basis for such charges on taking instructions.”

Mr Lungu’s failure to inform the client in writing without reasonable cause amounted to professional misconduct or conduct unbefitting a lawyer. It was ordered that Mr Edgar Chagwa Lungu should pay back that amount within sixty days from 4th March 2010 when the ruling was made or face further disciplinary proceedings.

In contravention of the order of the LPC, Mr Lungu only paid K9,000.00 of the K36,080.42.

This forced Ms. Kanyanta to sue in the subordinate court under cause no. 2010/CRMP/688 on 6th August 2010 for the balance of K27,080.42. Mr. Lungu admitted guilt to the claim in court on 19th August 2010 and applied to settle the debt in instalments of K5,000.00

  3. Editor, You are fishing in a dry pond in pursuit of vanity. EL was not offering his services pro-bono but but as a service for a fee.

    He did not misappropriate the client’s money as insinuated and cheaply politicized with zero dividends. The only sin EL committed was to have fearlessly defended Mr. Sata as his lawyer at the peak of persecutions. Everyone was scared of defending Sata the fearless politician whose galvanizing political acrobats increasingly threatened the status quo. The state was targeting lawyers that were serving Sata. EL drawing his courage from his military training chose to serve Sata in the courts of justice for all trumped up charges Sata faced. He won all the cases to the disdain of his opponents.

    There you are doing copy cut out of very limited knowledge of the system. Some of us know the lady very well who sought legal services from EL then lead lawyer at Andrew Masiye and Partners. She had no money to pay for the legal services. As such she entered into an agreement for the legal fees to be deducted from the award or compensation based on the judgement on winning the case. Accordingly the law firm deducted its fees with balance paid to her. Unfortunately, the same poor lady was used by the SD to turn around against EL for the deducted fees they had mutually agreed as fees for the legal services rendered. Again, EL was never offering pro-bono services but at a fee.

    If you are sober and sincere investigative journalists you should get to this lady to help you understand her ordeal at the hand of the SD who pushed and manipulated her motive.

    Therefore, this smear will only consolidate the public passion for EL. People have settled for the EL their fellow common man than an elitist because of his natural simplicity, humility, sense of stability, national unity, patriotism, courage, temperament, meekness, reality, proven service in the public service. As Defense Minister the Defense and Security establishment remains the most satisfied only matched to the morale they had under LT General Christon Tembo. You cannot take away it away from EL. The man is the most accepted candidate among candidates today though some have been running the race since 2001 and 2006.

    • In your DREAMS! Mwabomfya naka legal term ati “pro-bono” to try and intimidate the lot. EL has already said it himself that he had no capacity to run the office of president but being pushed by CORRUPT ELEMENTS like Nsanda.

      So “chill” instead of wasting space with such stories because I also know EL personally from Barclays.

In case you`ve no ability to comprehend, there was no letter from the Mrs. Kanyantta allowing Lungu to deduct some money. Second, Lungu failed to pay back the money even when he was given time to do so. What do you call such a person, Simple and plain, a thief!

  5. He accepted that he used the money himself and paid later. Meaning he was guilty. Laz found him guilty. In the west he can not even be allowed to seek the Office of president. He is guilty as charges.

  8. This article reminds me of the story in the Bible (John 8:3-11)where Christ (who was also called a drunkard by some by the way) dared any one who did not have a sin to throw the first stone in judgment of a woman caught in adultery. I am sure you all know what happened.

    If Edgar was a thief as the article seems to suggest would he have admitted that he had committed a wrong – if at all the documents are even genuine?

    I know of many lawyers who do this after winning a case – they get costs from the unsuccessful litigant in court and also bill their own client starting with a payment of a deposit (I don’t know whether you can call this stealing from the client in the real sense of the word). LAZ could have eventually ruled that this was wrong but lawyers are still doing it. In this particular scenario Edgar appears to have admitted his wrong after the LAZ ruling. How many of us can do that? Did Edgar learn his lesson after this?

    The lesson here, which proves the quality of the type of person Edgar is, is that when you judge your friend remember that the same standard will be used against you. When you are judged and are found wanting, do you admit and confess? I challenge all lawyers to fully disclose themselves that they refund the huge deposits paid upfront by their clients once they recover their costs from court.

    To the non-lawyers who have been in this situation with your lawyers it is time you started claiming your refunds if LAZ has indeed ruled this way on this matter!

If you think the victim was injustly treated or betrayed tell us what else do you know about the matter and what effect does this impose on your life? Seeing that the Said Lawyer is contesting in an election , you have become wise and a smart instigator of hatred. Non of us has never wronged any person, even you though bold enough to point your finger on your fellow homo sapien as a wrong doer.

    Your aim is to inflate our faculties with your thought and attitude toward Lungu. That is non of your business. Just maintain your shallow idiosyncracy and see your way forward.     • You are not polically neutral as you claim. By claiming that you are politically neutral after what you have said, you have poved that you are not honest. Integrity is lacking in you. It is clear that he had used his client’s money. He admitted and agreed to refund the money. Even in court he did not offer any defence. His guilty is crystal clear. Do not defend the undefendable. The man is not suitable for the office. He should be rejected by all well meaning, responsible and patriotic Zambians.

  12. Agony is having convicted thieves, like E.L, Masumba and Mpombo,stand for political positions, even the national presidency. I will be shocked if Zambia will vote such riff raffs.   15. Lessons from this story
    a) Always have a signed agreement. It seems Lungu had a verbal agreement with his client – the client changed her mind and there is no way he could prove that there was an agreement before LAZ.

    b) Always do the right thing – It is today’s actions that shape tomorrow’s realities.So today do the right thing – it seems Lungu did the right thing. He could not prove his agreement with his client and he paid her back her money.In the end she swindled him – he provided a service and she did not want to pay for it. Always do the RIGHT THING.

    c) Time is a great equaliser -time has given the story its bluntness. The Post worked hard to pull EL down based on this, but because time has passed it is already a none issue for many Zambians that are looking for a new leader at a different time in their history. USE YOUR TIME WISELY!

    d) There is power in forgiveness – finally people do forgive. It is one of the great attributes of African theology, philosophy and worldview. Remember as Africans we had no prisons because we believe that there is no offense that cannot be forgiven. Every punishment is sufficient. The Post and its unforgiving attitude tried very hard to portray Edgar as a Thief a Drunkard just as you are doing now on this paper – but the people of Zambia have already forgiven Edgar Lungu. Ba Sata appointed him to all those portfolios knowing fully well all these stories – but he forgave Lungu. So FORGIVE and your LIFE will be a BETTER ONE.

    Edgar Lungu will be your president next week because that is what the majority of the Zambian people want. I therefore urge you to come to terms with that reality so that you can contribute to the success of Zambia beyond January 20th 2015.
