Opposition UPND outspoken Lawyer Martha Mushipe has been declared bankrupt by the Lusaka High Court.

 

The High Court has since ordered that Mushipe’s property be repossessed in a matter where she failed to settle a loan from Indo Zambia Bank.

 

The judgement was delivered after Ms Mushipe failed to appear in a case in which Indo-Zambia Bank had sued her demanding over K200,000 debt.

 

Indo-Zambia Bank was demanding payment of funds advanced to Mushipe under an overdraft facility secured by an equitable mortgage and legal mortgage over the said property.

 

Ms Mushipe came to limelight during the August elections when she harangued Electoral Commission of Zambia officers accusing them of rigging the election results in favour of president Edgar Lungu.

  2. Paying back these loans is rough. What with the failing economy resulting in falling income. Luckly she wont be disbarred or have her license revocked. In other words she can still practice if she so wishes.

  4. Can a bankrupt person practice iwe. May be sha has legally stolen from the Bank. because the Bank will have not recourse to that money if the property is sold and cant be equal to what was borrowed

  5. POLITICAL VENDETTA: HOW IT WORKS! A ruling power cries; this person is a threat to our security. We need to cripple her completely! The powers ask all banks to give them the financial obligations of the targeted individual. So if the individual has an overdue, but negotiated loan repayment agreement with the bank; the powers that be tell the bank – ‘hey, why are you not using clause xyz to recover the funds from this individual? Do something, or else we will investigate your bank for not adhering to banking regulations!’ The message to the bank is very clear. Where the matter involves people like Martha Mushipe, who are perceived enemies of the powers that be, the message is dangerously clear and frightening. The banks suddenly become very hostile to the individual the powers that be wish to sort out.

  9. She should appeal to Supreme Court against judgement. Mushipe has enough properties and therefore, she cannot fail to pay K200,000. This ruling is malicious and politically driven.
