ConCourt refuses to declare Mutati MMD President

The Constitutional Court has thrown out a case in which Raphael Nakachinda was challenging the leadership of Nevers Mumba as MMD President.

Nakachinda, who is the National Secretary of the Felix Mutati faction, had sought the intervention of the Constitutional Court to declare Mutati as the legitimate MMD President.

However MMD lawyer J. Madaika raised a preliminary issue which contested this behavior and asked the Court to throw out the case.

In its ruling, the Constitutional Court threw out the case and awarded costs to Dr. Mumba.

This is the second time that the Courts have recognized Dr. Mumba as MMD President and awarded costs.

The first time was when the Supreme Court sitting in Kabwe recognized him as MMD President.

  1. Former President Mr Banda hand picked Dr Nevers Mumba as MMD President but when Dr Mumba refused to be manipulated by him, he them went for Mr Mutati – I think the two MMD factions need to just hold a joint convention in which a new leader would be elected, else the party is doomed forever.
