An audio recording has emerged in which a person believed to be the recently axed State House Permanent Secretary Emmanuel Chilubanama is heard telling some acquaintances that President-elect Edgar Lungu is creating his cabinet in Mfuwe because the election petition that is currently before the Constitutional Court has already been decided in his favour.

In the same audio, Chilubanama also claims recently hospitalised Roan Member of Parliament Chishimba Kambwili suffered heart complications upon learning that President Lungu had left him out of his latest cabinet.

Naawina akale…so apa na cabinet naapanga akale. Mailo alefika…naapanga cabinet apa (he [Lungu] has already won [the petitio]…he has already constituted his cabinet. He is arriving tomorrow… his cabinet is already in place),” he quipped.

He adds: “Ba Chishimba Kambwili uko balilwala baumfwa ati tabalipo (Chishimba Kambwili got sick when he heard that he has been left out).”

Asked if there was hope for Kambwili to be included in Lungu’s cabinet, Chilubanama answers: “Ba Chishimba? Nga bakapapo nishi bashuka but… *laughs* (Chishimba? He’ll be lucky if he is chosen but… *laughs*)”

Chilubanama, who was fired by Lungu on Monday August 29, is also heard saying former ministers Miles Sampa and Mulenga Sata have been making overtures to return to the ruling Patriotic Front (PF), a party they ditched in the run up to the August 11 polls.

In the one and half minute recording,  Chilubanama, who speaks mostly in Bemba, also mocks Sampa and UPND Vice President Geoffrey Mwamba saying they are broke and heavily indebted as their respective trucking businesses are limping due to lack of business.

Balefwaya ukubwela abena Miles Sampa ka, na Mulenga Sata (Miles Sampa and Mulenga Sata want to come back [to the PF]),” he says. “Nabalemba ati awe tulebwelafye mutweleleko…mukamona, just wait! Bakesa pa podium…bakesa pundafye ati awe…baleisa…no tatwaishibe efyo twalechita. Awe alabeelela. They’ve written Ati ah twalilufyanya, we didn’t know what we were doing (They have written [to Lungu] saying we want to come back, please forgive us… You will see, just wait! They will stand on a podium, they will say we didn’t know what we were doing… He [Lungu] will forgive them. They’ve written, saying we made a mistake, we didn’t know what we were doing).”

He goes on to say: “Kabili yapwa political career.…tapali… Elo balikongola ama trucks.…balebafwaya (laughs) balikongola ama trucks….awe before.…deputy minister..alikongola saana ama trucks…for transport business (Because his political career is over, there is nothing he can do. And he acquired trucks on credit…when he was deputy minister. It was for transportation business).”

Asked if Sampa was struggling to find business, Chilubanama replies: “Nikwisa angachita business? Tamumumona GBM? Balibesalila yard ku South Africa….inkongole…ama trucks yalya akongwele katwishi nga ni 250..baliyakomena mulya. Ema temper aya, taiweme gagame (Where can he do business? Can’t you see what is happening to GBM? His truck yard in South Africa has been closed because of debts. Those 250 trucks he got have been locked in the yard. That’s why tempers are high, the game is not good for him).”

But Sampa has rubbished claims that he along with Sata have written to President Lungu begging for forgiveness and asking to be allowed back into into the party.

The UDF leader says there is no element of truth to the claims, adding that he has not written a letter in the last six months.

“For the record; I have not written any letter in the last 6 months or so,”  Sampa said in a brief statement posted on his Facebook page.

He then quoted the words of Suzy Kassem saying: “Never judge someone based on the words of another. Instead, study the motives behind the words of the person speaking.”.

  1. Really? Already won? So what is the use of the Constitutional court if, like the usual High and Supreme courts, cases will continuously be awarded only to those in power? There will be war in this country and the very judges will be sorted out first, followed by the ECZ crew. These judges must uplift the constitution and not support thieving. Everybody knows what happened.

        • Lungu is not wining now, he already won the elections.

          It is up to the plaintiff to prove beyond any reasonable doubt that Lungu did not win.

          In the absence of proof beyond any reasonable doubt Lungu remains winner of the elections.

          Lungu had nothing to prove, it is HH who must prove .

          If HH does not have proof beyond reasonable doubt, then he is just wasting the Zambian people’s time.

          Now, from what is being reported it appears HH and his GBM were not prepared for what they claimed.

          It appears their claims were based on rumour and falsehood, some of from social media.

          It is not difficult to read where this case is going, because Zambians are funy.

          We have had cases in our courts in the past where a witness goes in the courts and says:

          “I don’t know anything”

          Why, because of cooking up false acusations frying lies as evidence.

          So can you even start blaming the courts in such cases that dispose themselves?

          Even a crawling child would know that some cases are likely to dissolve themselves because they originate from falsehood.

The republican constitution is being abrogated by then that boasted for having brought in an amended one after many years, police professionalism all gone, good at attending to marriage conflicts and in courts right has become wrong and wrong has become right. Dimitri you are right. Now that the LAW is being abrogated by those in front, what will become of us the least, SUFFERING. Chilusomething’s statement tells me that the Concourt is just telling the upnd to go to HELL in such a way that they look forward to the TRIP. Mark my words! These judges are supposed to be appointed by independent bodies and not by politicians (president)

  3. Zambian is a failed State with messed up institutions, therefore you can`t expect any sensible decisions from Zambia judicial institutions. Further, institutional theft is heavily institutionalized in Zambia. Regarding elections rigging was done in collaboration with key institutions i.e. police, ZAF, ECZ and judiciary. Just see how the ConCourt is handling key petition issues like custody of the election materials and transfer of presidential powers to the speaker, unnecessary adjournments and yet its straightforward. What Zambia is building are clear ingredients for civil war. Very unfortunate and sad that in this day and age Lungu is modeling such a path for Zambia.

  13. Chilubanama is correct, the judges are all buying time. Who thought Chulu could misfire in his first time as Chairman of ECZ. Obviously the judges were spoken to and all their demands met, the only thing remaining is delivering…they will Twist judgement towards that loser and then while they will be enjoying up there, his visionless crusade will plunge this country into disarray…

  14. The political playing field was far from being leveled prior to elections being held. We all saw how the PF made it hard for the opposition to campaign and the treatment that everyone who was perceived to sympathize with the opposition received. We witnessed the kind of violence this country has never experienced before, needless to talk about the disregard for the rule of law by PF and the hate speech. The list is endless. What breaks my heart is that the majority of Zambians don’t see anything wrong with this. Seeds of evil are being planted and we are just watching. Mind you these seeds will hatch into something we might not even be able to handle and the sad thing is the ones planting such seeds may not even be around to witness the kind of environment our children will live in.Elders & the so called clergy even have the audacity to go on national television speaking well of the orchestrators of the destruction of our beloved country. Have we been bewitched that we cannot see these evils and what they are doing to our country? I pray that we wake up sooner than later.

  15. Reading this reminds me of what God told to the children of Israel & Judah in the prophetic book of Micah.In the book, God among other things addressed the failures civil,religious & prophetic leadership,corrupt business practices & violence.

    In addressing failure of civil leadership, God said in 3:9-10, ‘Hear this, you leaders of the house of Jacob, you rulers of the house of Israel, who despise justice & distort all that is right, who build Zion with bloodshed & Jerusalem with wickedness. Further, in 7:2-3, God said,’The godly have have been swept from the land; not one upright man remains.All men lie in wait to shed blood; each hunts his brother with a net.Both hands are skilled in doing evil, the ruler demands gifts, and the judge accepts bribes, the powerful dictate what they desire – they all conspire together’

    On religious leadership, God had this to say in 3:11,’Her leaders judge for a bribe, her priests teach for a price, & the prophets tell fortunes for money.Yet they lean upon the Lord & say,” is not the Lord among us? No disaster will come upon us’

    With prophetic leadership, God in 3:5-7 said,’As for the prophets who lead my people astray, if one feeds them, they proclaim ‘peace’; if he does not, they prepare to wage war against him .Therefore night will come over you, without divination. The sun will set for the prophets, and the day will go dark for them. The seers will be ashamed & the diviners disgraced. They will cover their faces because there is no answer from God.

    On corrupt business practices and violence, God had this to say in 6:10-13,”Am I still to forget, O wicked house, your ill gotten treasures & the short ephah, which is accursed? Shall I acquit a man without dishonest scales, with a bag of false weights? Her rich men are violent; her people are liars & their tongues speak deceitfully. Therefore, I have begun to destroy you, to ruin you because of your sins’

    The end result of these warnings which are very much applicable to the times we are living in looking at the things happening is that God judged & punished the nation’s of Israel & Judah like he will also judge all of us without exception. Brothers & Sisters, let it be known that true Justice will only come from God who will judge even the so called judges of our Courts – let us learn from God’s timely warnings as the end is approaching & all of us will account for our actions. Whatever one thinks, the current World we live in is absent of real justice – I rest my case & hope that those with eyes and ears will see & listen. …..

  16. If really what Chilubanama is saying is true, I don’t know. A zituation where the Court ruling is known even before the commencement of trial, no wonder Lungu doesn’t even want to handover power to the SNA. Then HH and GBM are very very right. Its up to zambians but JUSTICE must prevail

  18. Can the Zambian Judiciary rise to the occasion? The answer is Yes. What Chilubanama said puts the integrity of the ConCourt in disrepute. Is it going to serve the purpose for which it was created? The answer is No. This is most serious case it will ever handle being the first of its kind. Ruling against a party in power is not far fetched. In Austria, the Courts nullified the July 2016 elections. In 2015 Malawi courts ruled against Joyce Banda and this led to Peter Mutharika being declared winner.

    Some of my Malawians friends have asked me whether the Zambian courts are beyond reproach. At first I was confident. But now with audio I am filled with so much doubt. Just like what I have written before their decision has far reaching ramification both for the Judiciary and nation. Their office is a constitution office. So what can make them succumb to Edgar Lungu apart from corruption. I intend to agree with Daka who wrote about Micah’s prophesy that Judges are perverting justice because of bribes. Chilubanama is not saying from without. He is close to the Edgar Lungu. I feel embarrassed as a citizen of Zambia. When is the Zambian Judiciary going to show the world that no one is above the law? That they are beyond reproach?

    In South Africa a President or minister can be taken to court in his personal capacity while still in office. We see a ruling which was passed against President Jacob Zuma, where he was ordered by the courts to refund part of the money spent on his Kandla home.

  21. Lungu is in this situation because he employs young men like Kaizer Zulu and Chilubanama. These are youngmen who get easily excited with 4 bottles of castle or Windhoek lager. How does a head of State share his cabinet with drunkards like these? These guys easily open up when they are with their girl friends. The fact that he fired this Chilubanama fellow means there’s some grain of truth in this whole saga. I will not be surprised that the one who recorded this is Chilufya Tayali. He is fond of recording people after enticing them with a phone call. Remember that GBM recording? All in all Lungu can do better in choosing his team of Advisors. There is a lot of leakages from his office. he needs to seal the loopholes.
