Chilekwa sentenced to 25 years imprisonment

The Mongu High Court has sentenced Shebby Chilekwa 34, former President Edgar Lungu’s barber to 25-years with hard labour for murdering Lawrence Banda in the Kaoma Town Council chairperson by-election that took place in October 2019 contrary to section 200 of the Criminal Procedure Code of the laws of Zambia.

Sitting as Mongu Resident High Court Judge, Charles Zulu said that considering all the testimonies that were given by witnesses from both the state and defence lawyers’, the court has no reasonable doubt that Chilekwa murdered Banda in 2019.

Judge Zulu said the by-election in Kaoma district was marred with pockets of political violence and it appeared that it was fashionable to have guns and the use of violence which claimed a life.

He said during the incident that led to the death of Lawrence Banda, the accused Shebby Chilekwa was of sound mind and proved beyond reasonable doubt that he is guilty of murder.

In mitigation, Defense lawyers from Makebi Zulu and Advocates have pleaded with the court to reduce the case from murder to manslaughter because Shebby Chilekwa is the first offender and still a youth of 34-years old, adding that his life will be doomed should the court convict him with life imprisonment.

The Defence lawyers said the court should take judicial notice of political violence that happened in Kaoma adding that if the UPND had adhered to the Electoral Commission of Zambia time table, the life of Lawrence Banda would have not been lost because UPND officials ambushed the PF vehicle.

They pleaded with the court to give Shebby Chilekwa a second chance, saying to err is human but forgiveness is divine.

They added that Chilekwa has spent 402 days in incarceration as such, it is appropriate to give a lesser sentence.

And delivering the judgement today, Judge Charles Zulu said he has taken into considerations all the mitigation factors, and the balancing of justice and mercy thereby sentencing Shebby Chilekwa to 25 years with hard labour.

Judge Zulu said political violence should not be accepted as a norm adding that the existing political impunity then should not continue to flourish in a good society.

Meanwhile, State in the Mongu High Court yesterday entered a nolle prosequi in a case where former Patriotic Front Deputy Secretary General Mumbi Phiri was charged for murder of Lawrence Banda in October 2019 in Kaoma district of Western province.

When the matter came up for judgement, Senior State advocate, Kanoka Sifali on behalf of the Public Prosecutions for the Republic of Zambia, pursuant to the powers from section 81 and 82 of the Criminal Procedure Code discontinued the case against Mumbi Phiri.

Meanwhile, Patriotic Front Vice President Given Lubinda has expressed disappointment with the nolle prosequi against Mumbi Phiri saying the party wanted to see her being acquitted because the court has not found her guilty.
