As the Constitutional Court tables the 2016 presidential election petition bronght by the opposition UPND on Thursday, the Court has been called to rise to the occasion be magnanimous to defend the constitution.

 

The UPND has assembled a team of  12 constitutional lawyers to advance it’s case. A member of the team has informed Zambian Eye that the team is happy with evidence that has come so far.

 

A concerned Zambian and democrat says he is happy that so far the constitutional court has risen to the occasion once and defended the constitution in the two critical cases brought before it.

 

“We are proud that at least one arm of government upheld the constitution.

 

Now the world, Gods people And the citizenry are expecting them to consider the facts and facts alone to deliver the right verdict. If there is any doubt as to the veracity of the elections…then there is reasonable doubt. Then nullify or at worst call for the recount and verification of votes and ballots in the interest of being cost effective.”

    • I wrote a comment here warning all those who were aiding and abating the rigging on Lungu ‘s behalf that once it is done Lungu will become a full blown dictator. He will want to shutup all the people instrumental in rigging by eliminating them one by one in case they spew some information later about how this election was tempered with as a result of verbal diarrhoea. Emanuel Mwamba is one such guy.

      Like I said they will start disappearing one by one because they are part of Lungu ‘s rigging schemes people wont raise eye brow over them. But people like Mwaliteta who were bent on doing good will have people on his side all the time to make it hard for Lungu to kill them.

      One was killed in kabanana, Kasaro is going to die next it will Emanuel Mwamba and his group. All this Lungu will try to do cover his tracks and destroy blackmail that might weaken his leadership.

      With hunger and poverty looming Zambia as a result of Lungu’s incompetence, he will not manage to keep these people silenced at a fee. best solution he just eliminate them end off.

      So beware if you played a part in rigging just know Lungu and his dogs are coming are coming your way to get you because you might talk.

      Good will always triumph over evil.

        Whether nullity or not.
        Whether petition is thrown out or election nullified, the position remains the same – ECL is the head of state for the next five years. If we go back to the polls, there will be a bigger humiliation for HH.
        Voters will be extremely angry and they will appeal to those who did not vote to come out in numbers to defend their choice.
        In Zambia, you do not go to state house through the courts of law, but through the ballot. HH will soon learn this.
        The Constitutional Court does not vote, it just interprets the law, buy THE PEOPLE VOTE. Watch this space!!!

        • Correct me if I am wrong. My understanding is that the Concourt is being asked to interpret the law regarding the conduct of the recently held election and not to vote.

    I’m very sure they Will proof to zambians and The world y we call them lordships – i have never doubted them.
    Currently, Zambians are hopeless and have Just put all Hope in them as they have no one to defend them.

  5. Today is a D-Day for Zambia’s Constitutional Democracy.Concourt has the most important and onerous responsibility to save the Nation from the forces of darkness. Concourt should put personal interests aside and protect National interests. Concourt will determine the future of elections in this country.This will be a historical judgement which will determine the direction of Zambia’s future. Most Zambians have put their faith in God to inspire Concourt to resolve this impasse in the best interest of Zambia. Bless Concourt and our country,Zambia.

  6. it’s only nullifying that would make sense. recounting will yield the same results as these elections where rigged by ECZ. if its recounting then ECZ is already preparing ballot papers in the boxes to reflect the results they claim.

  7. free and fair concourt. Let it do its work don’t intimidate it with all the emphasis of always saying 12 or expert legal team. we seen its no biasness before and we hope it will uphold fair judgement and all will accept its ruling at the end.UPND family and also PF family.

  8. Waste of time. Upnd list in 6 of the 10 provinces, including Lusaka and Copper belt with the highest number of voters. How can they claim they won? The three provinces where they won equally broke the electral code of conduct. They transported people to polling stations and openly campaigned for HH on the voting lines.

    • It is ECL who campaigned on the day of elections by standing out through the sunroof of the car whilst raising his clenched fist, a symbol for the PF, all the way to Chawama Compound. Indeed, it was his constitutional right to have a presidential motorcade but he breached the electoral code of conduct by raising the PF symbol. ECL could have remained seated until he got to his polling station. In future, to avoid such misunderstanding, the Republican President should be voting from a Polling Station that is closer to the State House.

  10. This Petetion is important not just for this election but future elections. It will set out procedures in the conduct of our elections and hopefully clarify what roles are played by ECZ and Stakeholders. This will help explain the role of a seating President in the day to day running of electoral processes. It will help outline dispute resolution during the election and also outline remedies for breaching the electoral law and procedures. Concourt’s judgment we hope will help clarify roles of various stakeholders in the administration of electoral processes.The court should also outline how electoral offenders and fraudsters should be punished to deter such practices in future. We want the best candidate to win so that our votes can count and not be stolen. Most Zambians will not participate in future elections if they know that the very institution which is supposed to protect our votes does not do so.Hope Concourt will help restore some confidence and trust in our electoral processes. We ask God to inspire and guide Concourt in resolving this dispute in the best interest of all Zambians now and for the future.God bless Zambia we pray!

  13. while the outcome may not necessarily favour the petitioners, this petition will however be a landmark in that it will expose the crookedness of the current administration. I wish it could be given more than the stipulated 14 days so that the huge amount of evidence could adequately be analysed. There will be incredible exposures in this case. Well done UPND. You may not get it now, knowing how such petitions are handled in the World but there will be great exposures and some people will remain with indelible stains after this exercise. To the UPND family I say take the heed of AL-Jazeera that you should not play into the trap of PF. Stay peaceful and continue mobilising for the next elections. This will show the difference between you and PF. Sweet victory is the one that comes after a hard struggle than the one achieved through theft. PF will not prosper after this. They have just dug their own grave. Mr. Lungu has lost a chance of being among the most respected elder statesmen in the World. He will now go in the records of the Worst Presidents in the World

My friend if you were a president you would be a dictator because for u whether petition is thrown out or election nullified, the position remains the same – ECL is head of state for the next five years! If that is not dictatorship then u don’t know dictatorship and we don’t need leaders like u. I wouldn’t be surprised to hear that u are a dictator already in your small world.   19. why recount without a G 12 form never think that way votes have been stolen suppose a thief stole from your house you arrest the thief take him to court is the court going to tell the thief to return the stolen items and go free I don’t think so this is the same as stealing votes someone is going to be punished if found guilt

    Honesty is the best Policy. Fellow citizens, it is high time that we became honest with ourselves and each other. When people lie and act deceitful it will eventually catch up to them. Lies can boost our egos but they weigh us down politically, economically and socially. Only the truth will put Zambia at ease. Only the truth will enable us to stand and sing of Zambia proud and free. In whatever potofolio, let each trully patriotic Zambian refuse to let a lie to overshadow the truth.

  22. zuluman, whats ‘Noti ifya mafi yan’gombe?’ Give a chance to those who have a complaint about elections to complain. Also don’t forget this ‘mafi yan’gombe’ is what feeds the nation. It is what has educated, clothed, housed, a lot of people in our beautiful country. Even medical can be added to the list which is endless.
