UPND President Hakainde Hichilema has revealed that the UPND is considering asking its legal team to file a motion to reopen its 2016 Presidential petition in the Constitutional court following what he described as continued mischief by the Concourt of entertaining PF appeals on ministers illegal stay in cabinet contrary to constitutional provisions.

Mr.Hichilema said it is surprising to note that the Concourt which prides itself in being a court of original and final jurisdiction is being entertaining appeals against its own judgements by the PF such as attempts by first the Attorney General and now Davies Mwila to reconsider its judgement on the illegal stay of ministers prior to the 2016 elections.

He said this arbitrary abuse of the court process by the PF would render the UPND decision to file in a motion to reopen the presidential petition justifiable.

” My colleague (GBM ) and i will soon sit to make a decision as a party.We want to reopen our presidential petition in the constitutional court.The Concourt has continued entertaining appeals by the PF.Am sure we shall soon make a decision on this matter.That will be equity.The PF and the Concourt have created an opportunity for everyone to see.If they don’t entertain reopening our petition why should they entertain reopening the motion on the ministers serving beyond their constitutional lifespan,” he said.

“This is what happens when you are a crook.You think you are smart when you are not.You are merely creating new cracks.Busy abusing the courts,busy abusing parliament.They are now saying we can all go back to the Concourt to challenge Concourt decisions.We want our petition reopened,”President Hichilema stated.

On attempts by PF supporters to halt the impeachment process currently before parliament,the UPND leader said there is nothing sinister about the process which is aimed at impeaching an individual occupying the Presidency but has been transgressing the Constitution in many respects,adding that the impeachment is about Mr Lungu for the crimes against the Constitution.

He added that the impeachment process is a creation of the Constitution just like the Presidency is a creation of the Constitution and the two should be dealt with fairly and equitably and accused President Lungu of making the country ungovernable by his own conduct.

” This is also a test on the Speaker of the National Assembly Patrick Matibini who in 2012 allowed the motion to remove the Presidential immunity of Rupiah Banda despite the action being challenged in court.In his ruling on that day,the speaker said court processes have no bearing on parliamentary motions as the removal of immunity is parliamentary and not judicial business.Here we are also saying the impeachment process is a parliamentary and not Court process.Matibini declared the Chilanga seat vacant despite knowing very well that Keith Mukata had appealed against the conviction and sentencing.This is also a test on the Speaker on how he is going to entertain this wanton abuse of institutions of governance by the PF when he clearly created a precedent,” the opposition leader said.

“The PF has created a crisis.Crisis in the Concourt,crisis in Parliament,crisis in the economy,crisis everywhere.To be honest this Lungu guy has just failed to govern.He took over a role that is too big for his capacity and his style of doing business.He is setting a very dangerous path for the country to walk on.He is destroying the Legislature,he is destroying the Judiciary and the Executive is gone through corruption..How will the country function.Jungle law is about to set in and it’s time all of us Zambians come in numbers and say NO to this introduction of the Jungle law,”he added.

President Hichilema said Zambians should test the Concourt by asking it to reopen the 2016 Presidential petition and see how they will deal with the matter and added that President Lungu and his croonies were busy scheming for their survival in the night just like they schemed against the UPND Presidential petition in 2016.

“They have been saying there is no motion in court relating to the Presidential petition.Today because there is an impeachment,they are saying there is a petition in the court.They are now dusting the motions which have stayed for more than a year to prove their desperation.This is an indictment on the court.We shall wait and see how both the court and parliament will handle the issue of our petition and impeachment,”President Hichilema said.

The UPND leader was at flanked by his deputy Geoffrey Bwalya Mwamba and National Chairman Mutale Nalumango.

  1. I think HH must be a mental patient needing urgent medical examination. Surely how do exhume a dead issue at the expense of party mobilization exercise, he is certainly an under five politician. Before he realizes it will be too late, he thinks 2021 is many years away. He will cry again that my vote has been stolen.
