Dr Katele Kalumba a Minister and National Secretary under the MMD administration has advised UPND president Hakainde Hichilema to concede defeat.

 

Commenting on the decision by Hichilema to challenge the reelection of Edgar Lungu in the court of law, Dr Kalumba says Hichilema or HH as he is popularly known should learn from Michael Sata.

Dr Kalumba who campaigned for Hichilema in the 2015 Presidential election said this in a statement below:

 

There are times when “No” really means just that. You cannot stretch a loin cloth to cover your exposure beyond its size. There are things that cannot be “One Size” fits all.

The nature of democratic politics is that it is strategic. It requires four principle elements. These are:

-Power strategies,

-Position strategies,

-Player strategies; and

-Perception strategies.

There are details in these elements that any political leader and his team of campaigners cannot ignore or be ignorant of. If it is the case that your Party in an election is incompetent to apprehend these strategic issues, it is game over.

The greatest measure of any politician is not how he celebrates victory but rather how he accepts and concedes defeat.

ECL has won this election; matter of fact. It is not a question of law but of how he prepared for his political strategies.

Edgar is entitled to celebrate his victory. The question is, in a democratic society like ours, have losers learnt how to accept defeat?

*In 2008, the late Michael Chilufya Sata (MHSRIP) set the standard of accepting defeat.*

Having complained to ECZ he realized, the game was over. He did not go on a legal hunt for imaginary electoral incidences, but simply prepared to fight another day.

How I pray young politicians could learn a lesson or two from Sata the Great. For some of us whose political careers were mentored by him (Sata), we know this.

Dr. Peter Machungwa and I, on whom he unleashed his greatest venom as his Deputy Ministers, for me at Health and for Machungwa at Labor, we learnt how to take a public punch the Cobra could unleash through the Post Newspaper and live to learn another day.

Guy Scott lived through this too. I just wonder whether he cannot say to his principal (HH), that the game is over. Seven provinces have now become Edgars strongholds against the three commanded by brother HH. This scenario is very important and should not be ignored in self introspecting the preferred leader for the majority of Zambians.

Sata taught me that in politics, it is not how clever you are, but how best you can read what is going on. May the whistle be heard. If you have not heard it, then there really is something wrong with you. Pray not.

I am a disciple of reasonableness. Incidentally, for those who flourish in the pigstye of insulting me whenever I express my opinion, I just have the words of Paul in 2 Corinth 12:5-11. Peace and God bless.

    • Those who say ECL stole the election, listen!!

      Suppose we say that the 14 days limit prevented the thief from stealing his friend’s victory by manufacturing fake, and cooked evidence.

      But time was not enough for the thief to carryout his schemes. Now he is crying that he needed more time organise the required recipe for cooking evidence.

      Some of the recipes required included:

      A) transferring ECZ material to the courts in order to work with an accomplice in the courts to change things in favour of the thief.

      B) impound ECZ trucks carrying election materials and steal the materials to create irregularities that would then work as evidence the the elections were flawed.

      C) transfer power to the speaker with the view to negotiate a way to disadvantage the incumbent. They have been insisting on transfer of power even when they know that there is no transfer power following a petition of results of the initial ballot.

      The initial ballot is covered under Articles 101 and 102. There is no transfer of power following a petition made under this. And this is where the failed petition came as we had just done round 1 of elections.

      The second ballot is covered under Articles 103 and 104. This is where transfer of power to the speaker comes in. The failed petition did not fall under here because this applies to round two of elections – meaning if you hold initial ballot, the results are petitioned. Then after you go for round 2, results are petitioned again, such are covered under 103 and 104.

      HH and his team have been citing articles (Articles 103 and 104) that refer to second ballot deliberately so that they deceive the public and try force the incumbent to wrongly transfer power to the speaker under a wrong round of elections.

      I don’t know why HH thinks that everyone thinks like a child in this country.

      Such is a very serious insult to the zambian people.

      What do you understand by the statement:
      “Students must write their exams within 14 days”?

      Does the above sentence imply “students must commence their exams within 14 days”? or,

      does it mean “students must finish writing their exams before or on the 14th day”?

      You see, indeoendent interpretation of law does not support the idea of taking sides in the matter, but looking at the matter from an objective point of view.

      So don’t try to twist law to support your view. So if you have no case, you have no case.

    • How do you view losers who say in advance that if lose I will not accept. If I win I will accept.

      They lose 47% to 50.35% TTY they refuse to accept. They say the zambians want me this time around.

      They say the election had so many irregularities such as G12 forms .

      But they then ask for a recount and say the same election if the recount shows that I won I will accept, despite the said G12 form.

      They petition, but waste time celebrating that they have managed to petition; bringing all manner of preliminaries.

      The petition fails through a majority rule by judges, 3-2. He says no I will not accept because 2 judges have supported me, even though 3 mischievous ones have no. Those 2 who have agreed with me are noble. Those who have not gone my way are crooked and mischievous.

      Just how do you handle a person like that?

      To me, either something has terribly gone wrong with him or he is merely a trouble maker.

    • Hh should not mislead himself and those around him. Law should not be seen to end at where he is pointing; it has implications beyond what one is looking at today.

      I have warned before that for those that are not careful emotions can be more influential than logic. Thus, beware of Mushipe and her brother Mwiimbu.

      The constitution is very clear:
      101(5) The ConCourt shall hear an election petition filed in accordance with (4) within fourteen days of the filing in of the petition.

      This does not in any way imply Sha commence hearing. Now, let us assume that the that HH was correct that it implied commencement if hearing.

      That means that the incumbent would remain incumbent even for a period up to 5 years as long as the matter is not rssolved, as there would be no time ceiling to the conclusion.

      That means if the initial draft was preserved and ministers were chosen from outside parliament, even cabinet would be in place and government would function for as long as the indefinite petition runs or up to the next election.

      Now, HH, GBM, and Mumba have current affairs in their approach as opposed to strategic thinking. This constitution, by putting 14 days upper ceiling, had strategic approach to matters – looking at the outcome tomorrow of today’s action.

      Now, where time limit is specified or stipulated in the constitution, the meaning of “reasonable time” means that allowing up to maximum allowable time within the confines of the constitution.

      It dies not mean reasonable time based on any individual’s views, feelings, opinion, or perception but what the constitution provides.

      You do not go outside of the constitutionally stipulated timeframe to get a subjective ‘reasonable time’s, no!

      Conclusion: does HH want to drain all the traces of personal integrity and get fully disgraced by complete defeat on legal battles before he can give up?

The constitution doesn’t encourage impunity for fraudulent and rigged elections so it provides for petitioning the results if such an election, of ciurse as long as one has the evidence to tender and prove. In this case, since the judicial process was aborted in the manner in which it was done, one should not say HH should concede defeat because he may not actually have lost. We font know. The court never even pronounced pursuant to section 105 whether Lungu was validly elected. The court even failed to make a ruling whether or not it was constitutional for him not yo hand over power to the Speaker of the house. What happened here is odious. Silence is conspiracy in support of impunity. It is stalking the fire by urging someone to concede defeat when that was never determined by a judicial authority. The onus is for Lungu to reach out to the opposition given the aborted nature of the process. This civil outreach could work miracles.

    • Baba – The onus is not on ECL to reach out to an opposition that refuses to recognize him as President. You failed to advise your HH before the elections and you are still failing to advise him now. Why did the petitioners fail to provide any evidence in the time that they had? Why shouldn’t we be free to assume that there was no “evidence”.

Katele you are a big fat lier, Michael Sata never conceded defeat the every time he lost election, but he always referred to the 2001 presidential election petition as the reason for him not to go to court because he had no trust in Zambian court system, because it took them 5 years to hear a petition, by the time they were still fiddling with it, another presidential election was upon us, and the petition became irrelevant, so the only way we shall prove that the legal reforms initiated by Michael Sata are now up to scratch, is to do what he was afraid to do.

HH is not representing himself alone to concede defeat, but rather the people who voted for him, who from the many election flaws, feel their victory, through their candidate, was stolen and merely want to see justice served. In Zambia, it’s no longer who votes that is important, but rather the one counting the votes, a situation that needs urgent attention & correction because if left unchecked, people will not see the need to vote.

  22. The petition has not been determined. It is alive in court. So, how does HH concede defeat? On what basis? You concede defeat when the electoral process is credible and results are clear. HH requested for recount of votes but that was ignored by the Corruption Court.

    Just look at how EL behaved during and after elections. Manipulating the judiciary, intimidating the judiciary, locking up petition witnesses on flimsy ground, Killing witnesses. Rendering the judiciary useless/invalid. Closing private media, promoting hate speech through the public media. I don’t think a person who has won elections can do this.

  23. HH is contesting the legitimacy of the results in the courts of law. So how do you expect him to concede defeat?

    I was thinking some level of education Katele has would help him think through logically. This explains why he was found in small hole which a human being can’t fit in Luapula. Corruption Court has breached the constitution in their action.

  28. I personally cannot respect Dr K Kalumba’s message.

    1. When you lose in a clear, fair game, its unreasonable to fail to accept defeat. In this case HH sought clarification and the final verdict was never arrived at. What does Dr KK say over the dribbling of Friday to Monday, Monday back to Friday because someone must be able to comment on that. There was debate on how to count the 14 days and that was seemingly resolved just a day before to say “tomorrow by 23:45 the case must be concluded”. Already that is unfair. Was nobody aware of how it should be calculated since the constitution was designed? Come that night, after some plea from HH/GBM 5 out of 5 judges sent the message to the whole Zambia that Monday the case continues, plus 2 extra days for each of the parties. The whole Zambia knew that, including Dr K Kalumba.

    Now because PF is above everybody in Zambia, including the judges, there were strong threats unleashed. The recommendation to proceed to Monday was categorised an unpardonable crime and whoever was for it would soon perish at the hands of PF (Powerful Force = PF, not necessarily Patriotic Front as u may think).

    Come Monday, who can stand against the wishes of the Powerful? Of course now from 5 over 5, we have 2/5 and its game over. I have no respect to anybody who fails to see injustice in this development. Or who only rushes to make conclusions and force other pipo to concede the defeat they are actually questioning.

    2. ECZ credibility is another concern Dr Kalumba is deliberately ignoring. We had one female presidential candidate. No wonder they say u can never go far if u ignore gender. She is the only one who has seen that our ECZ is constitutionally fine, but its composition right now is compromised; we have pipo there whose master is the powerful force. They cant present results as they come even all of us know that. the results ought to be properly cooked to the taste of the Powerful Force before ever announcing them. Edith Nawakwi says disband this crew, what about Dr Katele Kalumba on that. If ECZ was credible all this petition issues were not even going to be an issue of concern.

    3. Third is where he refers to Late
    Sata. There is a video where late Sata is seriously debating that he has not lost to Rupiya
    Banda. Even international observers feature. He talked of massive rigging in Eastern Province and figures being cooked by an “IT” man as he put it in the video. Yes later maybe he conceded but hunt for that video and get even the language, maybe fortunately having no ConCourt he never went further, so lets cite Sata with caution on this.

    4. Last is the issue of strongholds. Don’t tell me of strongholds if you haven’t cleared the issue of rigging first. Mare leading in 7 provinces doesn’t imply all 7 are strongholds unless u are defining stronghold differently. We are told Copperbelt and Lusaka suffered massive rigging via the same young man who had illegal access into private ECZ rooms. so scientifically speaking Lusaka and Copperbelt (even Central) cant be valid references. Why do I somehow take rigging to have been a reality? Because the president was crying to have the petition thrown out before ever hearing it. And true to his prayer it was not heard. How do you fear to hear an accusation when you are innocent?
    We don’t count provinces, we count votes. Look at the turnout of voters in some provinces? three of them swallowed in some cases by one!

    5. Sorry lastly now. On Dr KK praying. This is praying now to who? we should tell people when we repented from praying to something to start praying to somebody. If I still use charms my prayers are to something; not to somebody. Thank you.

After 50 or 100 years all what is happening now shall be reviewed, and, the analysts shall be able to see that if people in 2016 in Zambia choose a leader such as ECL given a choice against HH, we are likely not to be there when they will judge that Zambians reasoned as if they lived 100 years before or that those who lived a century ago reasoned better than the 2016 guys Katele and Keen Follower. In German this year 2016, they have conceded that what the govt did in 1913 against a group of people was genocide. In England, this year, Tony Blair has been held as having been irresponsible by engaging the country to war along side USA in Iraqi!

  33. Its such kind of advice that have led Africa to where it is now. Africa is backward because Africans simply throw up their arms in the air when they are faced with a problem even oppression. Everything comes to the desire of God. Come on if all of us were created by the same God, how come he desires very high standards of integrity for non Africans and low standards for Africans? I refuse to accept that whatever is happening here is of God’s design. I totally believe that ineptitude is what is causing this chaos in Zambia and Africa in General. Come the next elections in Zimbabwe, Mugabe will still rein high and our brothers and sisters will be advised to move on because God will have decided. So the collapse of Zimbabwean economy is of Gods design and Zimbabweans should just accept their status quo. RUBBISH! Acceptance of low standards is what has caused all this nonsense. I also don’t believe that Sata is our model politician to be emulated by everyone. If I were to emulate someone, I would go for General Miyanda, Mwanawasa and HH. To me they are great. Sata was just a riffraff who bullied everyone around. I will assess Lungu at the end of his term even though he does not give me much hope. Dr. Kalumba and other PF zealots, where are you getting the 7 Provinces for Lungu? I have results here and Lungu won in 6 and not 7 Provinces. Central was for HH and not Lungu.     • Boss it is not 3.5 and 6.5. it is simply 4 and 6. If you bring in your flawed Mathematics, then every province must go with decimals. You will then realise that Copperbelt and Lusaka were closer than you thought. I think let us use variables that are used in determining the Winner. Like @Beware Beware has said, it is votes that are counted and not provinces. UPND is not challenging the number of Provinces but the number of votes. Bu Grade 7 bwalipwa. Go higher in Education to start dealing with simple things like this. Province is not one of the variables used to determine the winner.

    Thank you Blackbird. This is how people get brain washed. They are all saying 7 against 3 provinces instead of correctly saying “6 against 4 provinces with rigging”. Again people should remember we don’t count provinces but votes. Also they shouldn’t forget that some provinces can be 3 in number but due to poor voter turnout they are swallowed by one province. But very simple brain washed minds say 6 versus 4 means ECL won. Good example is Arnold Mulenga Makumba above. read his question.
