High Court orders UPND not to expel MP Serving in PF Government

The Lusaka High Court has ordered opposition United Party for National Development (UPND) not to expel Solwezi central Member of Parliament (MP) Dawson Kafwaya from the party.

 

Judge Annie Sitali restrained UPND secretary general Steven Katoka whether by himself or by his servants or agents or any of them or otherwise from expelling Mr Kafwaya from UPND and from interfering with the rights and privileges he is enjoying as member of UPND pending the determination of the matter.

 

Mr Kafwaya who is North Western province deputy minister has sought an injunction order to restrain his party from expelling him after he accepted a ministerial position from President Edgar Lungu.

 

Ms Justice Sitali said that an injunction is necessary to protect Mr Kafwaya from expulsion from his political party pending the determination of the matter.

 

She said disciplinary action had been taken against Mr Kafwaya by his party for accepting an appointment as provincial minister made by the republican president but given the lofty status the constitution holds in society, its provisions must be given due regard by all members of society including political parties.

 

Ms Justice Sitali said that the disciplinary action allegedly taken against a member of a political party for obeying any constitutional provision must be properly interrogated.

 

She however, said that the defence by Mr Kafwaya that he has a legal duty as a member of the national assembly to accept an appointment from the president is a matter not to be determined at this stage but during the main hearing.

  1. if thats the case,even PF Shouldnt expel comrades GBM and Masebo .an appeal to president lungu to avoid unnecessary by elections..we need that money in hospitals,schools etc

  2. It is a game of chance. Siamunene, Monde and Poniso have enjoyed PF money even this boy Kafyaya as PF has been trying to fight HH and UPND quietly using the bad laws which lack morals. In 2016 we want HH to appoint only members of his cabinet from among the UPND members and beef it up with few outside parliament those that are professionals. We expect HH to come and take full control and clean up the mess started by Levy P. Mwanawansa. While connecting developmental issues that were created by the previous Presidents as he will bring about real economical development to the poverty stricken Zambia.

  4. The judiciary should stop being biased please be proffessional and not to be corrupt like this. Where is the difference between GBM and Kafwaya. If that is the case even GBM should remain as MP for Kasama.

    • There’s a big difference. The president can appoint anyone into his govt regardless of political party leanings.This doesn’t mean the appointed must quit his party. However quitting your party and joining another like GBM did means crossing the floor and saying bye to the people who voted you into parliament. These people have to be asked again if they want you to represent them. VIA a bye election of course

  5. The issue of serving two masters does not arise here when the President appointed an opposition member to serve in the government. One ought by now know that the master is the Zambian people and not a leader of any party. THE MEMBERS OF PARLIAMENT ARE OUR EMPLOYEES AND IF WE FIND THEM WANTING CAN BE REMOVED BY US as long as we follow laid down procedures.
    If the President of the republic of Zambia thinks you have the qualities to help improve things on behalf of the people of Zambia, he may consider appointing you and I am of the opinion that he first consults him or her before that is done.

  6. This tell us that UPND has people that are fit to govern this country everyone in UPND is very cleaver. and that tells us that in 2016 HH and his team ll to faill to bring development if voted into power.
