President Michael Sata has said there is no need for the country to have a new constitution contrary to his promise in the run-upto 2011 General elections that he would deliver a new constitution within 90 days once ushered into government.

Speaking in Mansa, Luapula province today, November 30, 2013 where he went to thank the people of that constituency for voting for his party-PF candidate in last week’s by-elections, President Sata said what is needed is just to make amendments to the current constitution. He said there was no need to over-hole the constitution.

President Sata after assuming power appointed a Constitution Technical Committee to look into the submissions made by citizens in all the Constitution Commission and then come-up with a draft constitution which would then be enacted to a new Constitution.

This process has been going on for over a year now and the team has come up with a draft document which is supposed to be presented to President Sata and the general public before it is enacted to a new constitution by Parliament or Referendum.

This process has gobbled millions of dollars and one wonders which way now for the new constitution which citizens have been ‘crying’ for in the last 20 years of the previous administration of MMD party.

This is not the only promise President Sata has u-turned on, he has also changed on his promise to issue National coverage license to private media.

On October 28, 2013 President Sata told off his Permanent Secretary then at Information and Broadcasting Service Emmanuel Mwamba for issuing national coverage broadcasting licenses to two private Radio stations.

You come, you Mr Emmanuel Mwamba, you give coverage to all of them so that Mr HH can now go and stand on Radio Phoenix. Mr Mwamba is there smiling. Have you seen? We are sitting here, the people who are killing our own people, there are there. The young people you bring. Can you tell me the justification,” President Sata told Mwamba. “The reason why the previous administration only helped ZNBC was to protect the integrity of this nation. You know it very well, since you have been Permanent Secretary, the opposition go and sit on Radio Phoenix and you know it very well that a person outside Zambia has bought shares in Radio Phoenix and there you are.”

  2. I am sure the President is expressing an opinion as a Zambian citizen and not necessarily decreeing. Yes, we need a new constitution so that not only will Zambians have the right to be empowered to remove governments through legal/democratic means by having enough information to vote wisely but to also demand rights which most African governments deny their citizens. The President should know that Parliament controlled by the ruling party will definitely remove all the Clauses which he is not in support off. That, definitely, is not the reason why he was voted into power. His job is to advance the aspirations of ALL Zambians whether in his party, in the opposition or non-partisan. Sir, thank you for your views on this matter, but I beg to differ with you Mr President. We need a new constitution. Please just facilitate the process, do your job and spend our money on that process wisely. If you instruct your MPs to support all the progressive Clauses in Parliament, then Yes, please use Parliament but if you intend to shoot anything down just because the opposition is involved, then please, let us go all the way.

    • He expressed similar opinion on the Roger Chongwe Barotseland massacre reports. His opinion became official government polcy. We are lucky, we do not need some historian to tell us what happened , and happening thereafter. I want to hide my face with shame for I convinced an entire clan to vote for the man.

  3. Did someone hear him properly? It ca not be true that he said, we do not need a new constitution. Sata of all the people can honestly say that today. Noooooooo? He said and insulted past presidents over the issue of failing to put in place a new constitution. Can he be the same person to tell the people of Luapula that there is no need of having? Iam sure he was joking as usual.
    One can not be surprised he said that. Iam sure he meant to say most of the people that voted in the Mansa by-election where after all not Zambians and needed not to worry about the constitution since they don’t deserve it. How else can one really think? He just told the people of Luapula that the Province has the most foolish MPs. This only tells you how the man looks at the people of Luapula. Only foolish people can accept not to have a new constitution.
    This is total madness.

    • No mwebantu. Sata is saying there is no need to have a completely new constitution. We can amend the one we have. There is nothing wrong with that. When you amend you remove what is not appealing. You can never come up with a constitution that is completely different from the previous one. He hasn’t U turned.

      • I think you do not know the genesis of wanting a new constitution. It emanated from the fact that we have had so many amendments and yet we do not get what we want. against that background, the people of Zambia through their leaders decided to have a new constitution. The fiasco of 1996 where people amended the constitution to prevent Kaunda from standing taught many of us the lessons. we are now faced with a situation where a vice president cant act because of the 1996 fiasco. Please give us a break. We just need a new constitution. Of course some old clauses will remain but many including the sacred bill of rights will be touched in the new constitution. The fear from the President and his A Team is big. He sees himself being less powerful since he loves and cherishes power so much. This is definitely a Big U-TURN!

The sadest part of it is that those who want the constitution NOW are doing it not for the love of this country but for themselves(as if there is democracy in their organizations). and those who are opposing(no democracy in thier party also) are also doing it out of thier personal gain. Zambia will only have a good constuition when both parties put our country first(can a blind lead another blind) lets have good constution in our churches NGOS and parties first then we have a good republican constutition

    Obtaining votes by false pretences!
    Moreover, causing a huge budget overrun through moneys wasted on the technical committee and to U-turn in mockery of the electorate is one of the many reasons why MCS should be impeached! It could have already happened in a normal country.
    With this attitude I don’t see PF conceding defeat if they were to lose the 2016 general elections and this is dangerous for our young democracy!
    This pronouncement has set the stage for PF to manipulate the constitution to satisfy some vegetarian’s wish for a one party participatory democracy!
    It would be interesting how this whole damn thing unfolds!
    We need to face this with the same zeal and courage our nurses have shown Shamenda and Kasonde!
    PF must go!

  8. Zambians are too docile a people. Power is in your hands, yet you always look up to just one person in the name of the President who is an interested party to give you a new constitution. Other countries have removed presidents by force, but in Zambia, a president no matter how much they insult people is a small god. Let the cobra teach you a lesson that you are dull.

KAYULA,u have a point.looking at these organisation’s constitution its pathetic.what these NGO’s P.F,MMD,UPND etc have is no better than our republican constitution.let them change theirs to reflect what they want to see in the republican constitution thats when they can talk of the big one.Otherwise they just want to change it for their personal selfish gain.MR President you are right.

  18. Good journalism required that a reporter quotes the actual words spoken by an individual (with quote marks””) and to state :

    The date and the (platform, venue or audience) where the quoted speech or words were spoken.

    Mansa says the President never uttered the said words attributed to him but someone from FDD did make reference to the new constitution as he spoke at some local radio station in Mansa.
